Common questions
What if the rental company already took the car?
Save what you have. Identify where the vehicle is and who controls it. Request important information in writing. A preservation request is not a court order and does not create a right to inspect the car. Do not enter restricted property without permission.
Should I refuse to return the rental car?
Not as a blanket rule. Document the vehicle before the handoff when safely possible. Seek prompt advice if serious evidence may be lost.
Can I sign a basic return form?
Read all of it. A basic return receipt may only record the handoff. Another form may admit damage, allow a card charge, or release a claim. Save a copy before signing.
What if someone else rented the vehicle?
If you can lawfully get them, save the agreement and the page naming authorized drivers. Also save records showing who was in the car and who drove it. Being listed or allowed to drive does not prove insurance coverage.
Do rental-car photos replace medical records?
No. Vehicle records document part of the crash. Each injured person should separately preserve medical care, symptoms, expenses, and missed-work records.
