Swing recall: first records
Before Changing a Recalled PACEARTH Swing
30-second answer
Stop using the swing now. Keep people away. If someone fell, get medical help first. Take safe photos before recall marking or other changes. Save the seat's condition, attachments, order details, and refund messages. Do not test the swing.
Legal information from the Law Office of Arta Wildeboer · Updated
Do this now
- 1Stop using the swing. Keep others away; do not climb to inspect it.
- 2Take photos from a safe place on the ground. Include the seat, logo, visible hardware, straps, support, and landing area.
- 3Save the order, seller name, instructions, original photos, and any loose parts you can keep safely and lawfully. Do not handle unstable equipment.
- 4Write down what happened and who saw it. Keep medical records and injury photos private.
- 5Follow CPSC recall 27-019. Before marking the seat, save photos of its original condition when safe. Keep all recall messages and submitted photos.
Avoid this
- Do not sit in, pull on, or load the swing to show what went wrong.
- Do not cut the seat or straps based on another product's recall. This notice calls for marking and a photo, not cutting.
- Do not delay urgent safety work. Note any changes made and why.
Save these
- Seat and PACEARTH logo photos
- Visible connectors, straps, chains, and support photos
- Order, seller, packaging, and instructions
- Earlier photos and repair or replacement records
- Witness details and a dated fall account
- Medical records, bills, and symptom notes
- Recall instructions, submitted photos, and refund messages
Common questions
Can I use it while waiting for a refund?
No. CPSC says to stop using the recalled swing seats immediately. Do not test the other seat from a two-pack.
What does the refund notice ask for?
Contact recall@pacearth.com. CPSC says consumers will be asked to write RECALLED on the seat and email a photo that includes the PACEARTH logo. Save the current instructions.
Does the recall prove what caused my fall?
No. The seat, hardware, straps, installation, support, use, and medical records may matter. A recall alone does not decide legal responsibility.
